New York Lawyers for the Public Interest representing New York Communities for Change filed a Notice of Intent to Sue the NYC Department of Education and School Construction Authority under the Resource Conservation and Recovery Act. New York Lawyers for the Public Interest filed litigation under a different law, the Toxic Substances Control Act, to compel the City to remove and replace all PCB-containing light fixtures in schools within the fastest timeframe possible. BE IT RESOLVED, that the Board of Education hereby retains the law firm of Kennedy & Madonna, LLP to bring legal action against various defendants, including Monsanto Company, for damages incurred by the Yorktown Central School District as a result of PCB contaminated caulking and other materials in the District’s buildings in accordance with an Attorney Retention Agreement, dated October 4, 2007
