EPA/NYC PCB PILOT PROGRAM

The City of New York (City) and the New York City School Construction Authority (SCA) reached an agreement with the United States Environmental Protection Agency, Region 2 (EPA) regarding the assessment and remediation of polychlorinated biphenyls (PCB) Caulk in public school buildings (Consent Agreement and Final Order [CAFO], Docket Number TSCA-02-2010-9201).

As a result of the agreement, the City is undertaking a comprehensive pilot study to evaluate the possible presence of PCB Caulk and preferred remedial alternatives.

Litigation

 

 

New York Lawyers for the Public Interest representing New York Communities for Change filed a Notice of Intent to Sue the NYC Department of Education and School Construction Authority under the Resource Conservation and Recovery Act. New York Lawyers for the Public Interest filed litigation under a different law, the Toxic Substances Control Act, to compel the City to remove and replace all PCB-containing light fixtures in schools within the fastest timeframe possible.
